TEMPORARY INJUNCTION PROTECTS ARMBANDS
The Watson Chapel School District has
been temporarily prohibited from enforcing disciplinary actions
taken against students who wore black wristbands or armbands to
protest the district’s uniform policies.
After a hearing in U.S. District Court at Pine Bluff on Thursday,
Judge Leon Holmes agreed to grant a temporary injunction requested
by the American Civil Liberties Union last week.
“This court is bound by the Tinker decision and there are enough
similarities in this case to grant the motion,” Holmes said.
The lawsuit claimed the district violated free speech rights and
asked the court to stop the district from suspending any more
students for wearing the armbands.
It also asked the district to remove any disciplinary records on the
suspended students, allow them to make up any work lost as a result
of the suspensions, and permit the students to participate in clubs
or extracurricular activities which had been taken away because of
the suspensions.
The hearing followed a lawsuit filed by the ACLU on behalf of three
students — Chris Lowry, 15; Colton Dougan, 14; and Michael Joseph,
16 — and their parents against the district, Superintendent Danny
Knight in both his individual and official capacities, and the seven
school board members individually and in their official capacities.
The three students were among a group that was disciplined or
suspended after wearing black wristbands or armbands to school Oct.
6 to protest the uniform policy and the way it was being defined and
enforced.
That policy prohibits wearing any item “on or over any part of the
uniform, except the school name, school logo, or school insignia.”
The ACLU said the students were wearing the armbands on their arms
and not over any part of the school uniform, and therefore, “were
not in violation of the uniform policy.”
At the hearing, Pine Bluff attorney Mike Dennis, who is representing
the school district, said the armbands could have been referred to
as bracelets and Holmes questioned whether wearing them was a
violation of the school policy, based on the 1969 U.S. Supreme Court
decision in Tinker vs. Des Moines Independent Community School
District.
In that case the high court said a school district could not ban
students from wearing black armbands to protest the Vietnam War
because the district wanted to avoid a controversy.
“The student plaintiffs have a clearly established right to express
themselves in an armband protest,” ACLU attorney Holly Dickson said.
“Wearing political messages to protest government policies or
express one’s point of view by use of armbands, political buttons,
logos, and choice of clothing are all forms of student speech
protected by the First Amendment.”
The judge chastised Dennis after the attorney questioned Lowry’s
mother, Wendy Crow, about other protest organizations of which she
may be a member.
At a school board meeting Oct. 10, the same day the lawsuit was
filed, Knight said Crow was a leader in the “Free the West Memphis
Three” group that is seeking new trials or pardons for three
then-teenagers convicted in the 1993 murders of three young boys.
Holmes said he would not allow that line of questioning.
Crow is a founder and leader of the FED UP (Fighting
Education-Depriving Uniform Policies) group that has been fighting
the Watson Chapel uniform policy and its enforcement.
Holmes offered potential trial dates of Nov. 16-17 or during the
week of Jan. 29, 2007. Attorneys in the case will confer and report
back to Holmes with their choice of dates.
